Terms of Use

These terms govern your use of photon. photon is published by the developer named as its seller on the App Store listing (“we”, “us”). By installing or using it you agree to them. This agreement is with us, not with Apple.

1. photon is a player. It supplies no content.

photon plays video. It does not provide, host, supply, curate, recommend, index or distribute any content of any kind — no channels, playlists, streams, films, shows, sport or live events.

Everything you watch comes from somewhere you supply: a media server you run, a subscription you pay for, or a file already on your device. You are responsible for those sources and for having the right to play what is on them.

Support requests about content will be declined. That includes asking us for playlists, M3U or Xtream credentials, channel lists, TV guide sources, missing channels, dead streams, or where to obtain anything. We can help with photon itself, and nothing else.

2. Licence

photon is licensed to you, not sold, for use on Apple devices you own or control, under the App Store Terms of Service and the Usage Rules in them. Do not redistribute it, and do not build, share or promote modified versions of it. Except where the law or one of its open-source licences says otherwise, do not decompile or reverse engineer it.

3. Acceptable use

Do not use photon for any unlawful purpose, to reach content you have no right to, or to get around a technical protection measure on anything you play through it.

4. What we are not responsible for

We cannot see what you connect to or what you watch, so we have no way to moderate, remove or restore any of it. That is between you and whoever runs the server or service.

Jellyfin, Emby and Plex are separate products run by other people, and we are not affiliated with or endorsed by any of them — their names appear only to say what photon works with. The same goes for any Live TV subscription: we do not supply, check or endorse any of them, and compatibility is not a recommendation.

Keep your own backups. A download on a device is a copy for convenience, not an archive.

5. The trial, and the subscription

photon is free for a week. After that it needs a subscription, or a one-off purchase if you would rather not have one. It is sold by Apple through the App Store, so that transaction is on Apple's terms and Apple issues the refunds, not us — see the Refund Policy.

The current price, the billing period and the length of any trial are shown by Apple before you confirm anything, in your own currency. They are not written into this document, because a price copied into a contract is a price that goes out of date.

Payment is charged to your Apple Account when you confirm the purchase. A subscription renews automatically, and a free trial turns into a paid subscription when it ends, unless you turn it off at least 24 hours beforehand; your account is charged within the 24 hours before each renewal. Manage or cancel it in Settings ▸ your Apple Account ▸ Subscriptions, on any of your devices. A one-off purchase is not a subscription: it does not renew and there is nothing to cancel.

Any unused part of a free trial is forfeited if you buy a subscription during it. Prices may change; where one does, Apple asks for your consent before charging the new price, and you can cancel instead.

6. Updates, availability and support

We may change or withdraw photon or any of its features, and an update may be needed for it to keep working with a given server or operating system. We cannot promise it will work with every server or every file.

We provide support at [email protected], within the limits in section 1. Apple has no obligation to provide any maintenance or support for photon.

7. Warranties and liability

So far as the law allows, photon is provided “as is”, without warranty of any kind. Our total liability in connection with it is limited to what you paid for it in the twelve months before a claim, and we are not liable for indirect or consequential loss, or for loss caused by a server or service belonging to someone else.

None of that touches your statutory rights. If you are a consumer, the Consumer Rights Act 2015 requires photon to be of satisfactory quality, fit for purpose and as described, and nothing here can take that away. If it does not work as it should, tell us — see section 6.

If photon fails to conform to a warranty that cannot be excluded, you may notify Apple and Apple will refund the purchase price. Beyond that, Apple has no warranty obligation for photon, and any other claim arising from a failure to conform is ours to answer.

8. Apple

We, not Apple, are responsible for any claim relating to photon — including product liability, any failure to meet a legal or regulatory requirement, and any claim that photon infringes someone's intellectual property. You confirm you are not in a country under a U.S. Government embargo and are not on any U.S. Government list of prohibited parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

9. Open-source components

photon includes other people's software under its own licences, listed at Acknowledgements. Where one of those licences gives you rights that conflict with these terms, that licence wins for that component.

10. Changes, law and contact

We may revise these terms; the effective date above reflects the current version, and anything significant will be in the app's release notes. They are governed by the law of England and Wales, and if you are a consumer elsewhere in the UK or the EEA you keep the mandatory protections of your own country's law.
